CONLIVES™ is a trade name (DBA) of Confort Live Essentials LLC. The terms “we,” “us,” and “our” refer to CONLIVES™ and Confort Live Essentials LLC, as applicable.

CONLIVES™ operates this store and website, including all related information, content, features, tools, products, and services, in order to provide you, the customer, with a carefully curated shopping experience (the “Services”). CONLIVES™ is powered by Shopify, which enables us to provide the Services to you.

These terms and conditions, together with any policies referenced herein (these “Terms of Service” or “Terms”), describe your rights and responsibilities when you use the Services.

Please read these Terms of Service carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.

By visiting, interacting with, or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or our Privacy Policy, you should not use or access our Services.

SECTION 3 - ORDERS

When you place an order through CONLIVES™, you are making an offer to purchase the products included in that order.

CONLIVES™ reserves the right to accept, decline, limit, or cancel an order where reasonably necessary, including in cases involving product unavailability, pricing or product-information errors, suspected fraud, unauthorized transactions, payment issues, geographic restrictions, or other legitimate business or legal reasons.

Your order is not considered accepted until we confirm acceptance and applicable payment processing has been completed.

Please review your order carefully before submitting it.

Cancellation requests may be submitted while an item remains unfulfilled. A cancellation request is not necessarily guaranteed and may be declined if the order has already entered processing or fulfillment and can no longer reasonably be stopped.

If we decline, modify, or cancel an order, we will make reasonable efforts to notify you using the email address, billing information, shipping information, and/or phone number provided with the order.

If CONLIVES™ cancels an order or an unshipped portion of an order after payment has been collected, any applicable refund will be issued to the original payment method.

Returns, refunds, and exchanges are governed by our Return & Refund Policy.

Unless otherwise expressly authorized, you represent that purchases made through the Services are primarily for personal or household use and not for unauthorized commercial resale or export.

SECTION 4 - PRICES AND BILLING

Prices, discounts, and promotions are subject to change without notice.

The price charged for a product or service will generally be the price in effect when the order is placed and will be reflected in the applicable checkout or order confirmation.

Unless otherwise expressly stated, displayed product prices may not include applicable taxes, shipping charges, handling charges, customs duties, import charges, or other charges that may be calculated separately.

Prices offered through CONLIVES™ may differ from prices offered by manufacturers, suppliers, marketplaces, physical retailers, or other third parties.

We may offer promotions that are governed by additional terms and conditions. If specific promotion terms conflict with these Terms solely with respect to that promotion, the specific promotion terms will govern.

You agree to provide current, complete, and accurate purchase, payment, billing, shipping, and account information.

You represent that you are authorized to use the payment method submitted for a purchase and agree to pay all authorized charges associated with your order, including applicable shipping charges and taxes.

SECTION 5 - SHIPPING AND DELIVERY

Shipping and delivery timeframes displayed by CONLIVES™ are estimates unless we expressly state otherwise.

We make reasonable efforts to process and ship orders within the timeframe communicated to customers.

Because CONLIVES™ operates using multiple fulfillment methods, some orders may be fulfilled from different locations or by authorized third-party fulfillment partners. Products within the same order may therefore be shipped separately and may arrive in more than one package.

The use of a third-party fulfillment or shipping provider does not change the fact that your purchase is made from CONLIVES™. Questions or concerns regarding an order purchased through our store should be directed to CONLIVES™.

Actual delivery may be affected by carrier operations, weather, transportation disruptions, customs processing where applicable, incorrect or incomplete delivery information, events outside our reasonable control, or other circumstances.

If we determine that we cannot ship an order within a timeframe we expressly promised, or within another timeframe required by applicable law, we will provide any notice, delay option, cancellation option, or refund required by applicable law.

These Terms permit you to use the Services for your personal, non-commercial use only.

Except where expressly permitted, you may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, transmit, sell, or commercially exploit material from the Services without prior authorization from the applicable rights holder.

Nothing in these Terms grants you any license or other intellectual property rights except as expressly stated.

The CONLIVES™ name, logos, product or service names, designs, slogans, and other brand elements are trademarks or trade identifiers of CONLIVES™, Confort Live Essentials LLC, or their applicable licensors and may not be used without permission.

Shopify's names, logos, products, services, designs, and slogans are trademarks of Shopify or its applicable affiliates. Other names, logos, product names, and trademarks appearing through the Services remain the property of their respective owners.

SECTION 7 - OPTIONAL TOOLS

You may be provided access to tools or functionality offered by third parties as part of the Services.

Except where otherwise expressly stated, we do not control such third-party tools and provide access to them on an “as is” and “as available” basis.

Your use of optional third-party tools may also be governed by terms and policies established by the applicable third-party provider.

You should review those terms before using such services.

We may add new tools, resources, features, or functionality to the Services in the future. Unless otherwise stated, such additions will form part of the Services and will be subject to these Terms.

We are not responsible for examining or guaranteeing the content, accuracy, availability, security, or practices of third-party websites that are independent from CONLIVES™.

If you leave our Services and access a third-party website, your use of that website may be governed by the third party's own policies and terms.

We are not responsible for transactions that you independently enter into directly with an unrelated third-party website.

This Section does not apply to products purchased directly from CONLIVES™ merely because a third-party supplier, warehouse, carrier, or fulfillment partner assists us in fulfilling the order. For products purchased through the CONLIVES™ store, customers should contact CONLIVES™ regarding order-related questions or concerns.

SECTION 9 - RELATIONSHIP WITH SHOPIFY

CONLIVES™ is powered by Shopify, which enables us to provide the Services to you.

However, purchases made through our Store are transactions directly between you and Confort Live Essentials LLC, doing business as CONLIVES™.

By using the Services, you acknowledge that Shopify is not the seller of the products purchased from CONLIVES™ and is not responsible for the sales transaction between you and CONLIVES™.

To the extent permitted by applicable law, you release Shopify and its affiliates from claims, damages, or liabilities arising solely from your purchase transaction with CONLIVES™, except to the extent such liability cannot legally be excluded.

SECTION 10 - PRIVACY POLICY

Personal information collected through the Services is handled in accordance with our Privacy Policy and applicable law.

Certain personal information may also be collected, processed, stored, or otherwise handled by Shopify in connection with hosting and providing the ecommerce infrastructure used by CONLIVES™.

Information submitted through the Services may also be shared with service providers and other third parties when reasonably necessary to process payments, fulfill orders, provide customer service, operate the Services, prevent fraud, comply with legal obligations, or perform other legitimate business functions described in our Privacy Policy.

SECTION 11 - FEEDBACK

We are under no obligation to maintain unsolicited Feedback in confidence, compensate you for unsolicited Feedback, or respond to it unless required by law or agreed otherwise.

We may moderate, edit, decline, or remove Feedback that we reasonably determine violates these Terms, applicable law, or the rights of another person.

You may not submit Feedback containing unlawful content, malicious software, intentionally false information, impersonation, or other content designed to interfere with the operation or integrity of the Services.

SECTION 12 - ERRORS, INACCURACIES AND OMISSIONS

From time to time, information available through the Services may contain typographical errors, inaccuracies, or omissions relating to matters such as product descriptions, specifications, prices, promotions, offers, shipping charges, transit times, and availability.

We reserve the right to correct errors, inaccuracies, or omissions and to update information when reasonably necessary.

Where an error materially affects an order already submitted, we may contact you to provide corrected information, modify or cancel the affected order, and issue any refund required by applicable law.

We may restrict, limit, or block Agent access where reasonably necessary to protect the Services, customers, security, privacy, infrastructure, or other legitimate business interests.

An Agent must not intentionally conceal or misrepresent that automated access is occurring, falsely impersonate a human, circumvent CAPTCHA or other access-control measures, defeat security restrictions, or misrepresent its identity when the Services reasonably request identification.

Where technical instructions specify an appropriate method for identifying automated traffic, Agents must comply with those instructions.

Nothing in this Section requires CONLIVES™ to permit automated or Agent access to any part of the Services.

We may suspend or terminate access to the Services, or portions of the Services, where reasonably necessary because of a violation of these Terms, suspected unlawful activity, security concerns, abuse of the Services, or other legitimate legal or operational reasons.

Termination does not eliminate payment obligations or liabilities that arose before termination.

Provisions that by their nature are intended to survive termination will remain effective, including provisions regarding intellectual property, Feedback, disclaimers, limitations of liability, indemnification, severability, governing law, and other rights or obligations that logically continue after termination.

SECTION 16 - DISCLAIMER OF WARRANTIES

Information provided through the Services is intended for general informational and commercial purposes.

Although we make reasonable efforts to maintain accurate information, we do not warrant that all information will always be complete, current, uninterrupted, secure, or error-free.

TO THE FULLEST EXTENT PERMITTED BY LAW, CONLIVES™, CONFORT LIVE ESSENTIALS LLC, AND THEIR APPLICABLE AFFILIATES AND SERVICE PROVIDERS DISCLAIM IMPLIED WARRANTIES THAT MAY OTHERWISE APPLY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

SOME JURISDICTIONS DO NOT PERMIT CERTAIN WARRANTY DISCLAIMERS. IN SUCH JURISDICTIONS, THESE DISCLAIMERS APPLY ONLY TO THE EXTENT PERMITTED BY LAW.

SECTION 17 - LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CONLIVES™, CONFORT LIVE ESSENTIALS LLC, AND THEIR APPLICABLE AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATING TO YOUR USE OF THE SERVICES OR PRODUCTS PURCHASED THROUGH THE SERVICES, EXCEPT WHERE SUCH LIABILITY CANNOT LEGALLY BE LIMITED OR EXCLUDED.

THIS MAY INCLUDE, WHERE PERMITTED BY LAW, LOSS OF PROFITS, REVENUE, SAVINGS, DATA, BUSINESS OPPORTUNITIES, OR SIMILAR LOSSES.

NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED, OR ANY RIGHTS OR REMEDIES PROVIDED TO CONSUMERS UNDER MANDATORY APPLICABLE LAW.

SECTION 18 - INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Confort Live Essentials LLC, doing business as CONLIVES™, and its applicable affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from third-party claims, liabilities, damages, losses, and reasonable legal costs arising from your material breach of these Terms, your unlawful use of the Services, or your violation of another person's legal rights.

We will provide reasonable notice of an indemnifiable claim where practicable.

Any indemnification obligation under this Section is subject to applicable law and does not require you to indemnify a party for liability that cannot legally be shifted to you.

SECTION 19 - SEVERABILITY

If any provision of these Terms is determined to be unlawful, void, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by applicable law or, where necessary, severed from these Terms.

The invalidity or unenforceability of one provision will not affect the validity or enforceability of the remaining provisions.

Our failure to exercise or enforce a right or provision under these Terms does not constitute a waiver of that right or provision.

These Terms, together with any policies or operating rules expressly incorporated by reference, constitute the agreement governing your use of the Services and supersede prior versions of these Terms relating to the same subject matter.

Nothing in this Section limits rights that cannot legally be waived.

SECTION 21 - ASSIGNMENT

You may not assign or transfer your rights or obligations under these Terms without our prior written consent where consent is legally permitted to be required.

We may assign or transfer our rights and obligations in connection with a merger, acquisition, corporate restructuring, sale of assets, transfer of the business, or other legitimate business transaction, subject to applicable law.

These Terms of Service and any separate agreements under which we provide the Services will be governed by the applicable laws of the State of Florida and applicable federal law of the United States, without regard to conflict-of-law principles, except to the extent mandatory consumer protection or other laws in your jurisdiction require otherwise.

Subject to any mandatory rights you may have under applicable law, disputes relating to these Terms or the Services may be brought before a court of competent jurisdiction in Florida.

Nothing in this Section deprives a consumer of protections, remedies, or jurisdictional rights that cannot legally be waived.
